The discrimination is mainly evident in terms of employment and of access to public and private services, particularly housing. 30 percent of petitions to HALDE concern geographical origin, then come health and disabilities, and lastly gender-based discrimination and trade union membership. Religion represents 2.7% of the complaints, in particular by Muslims and cults. With respect to other institutions, HALDE’s specificity is that it deals with the complaints itself and, consequently, establishes jurisprudence. In 2008, it dealt with 8000 complaints.
HALDE does not legislate, but makes recommendations and can propose mediation services. It cannot sanction, but it can initiate court proceedings.
Louis Schweitzer repeated that he was opposed to ethnic statistics, and more generally quotas, except for disabled people.
Louis Schweitzer also reminded CRIF’s commission that there is no right to not sit for school or university exams on certain days and that solutions needed to be found. Similarly, it is not possible to ban the use of digital door entry codes to residential buildings (Orthodox Jews cannot leave nor enter such buildings on Shabbat because there is no mechanical key).
